Intellectual property and limited license Vitanexia names, original curricula, prompts, scoring models, visual systems, software, events, written resources, graphics, audio concepts, and related materials are owned by or licensed to My Life Spark P.C. Access provides a limited, revocable, nonexclusive, nontransferable personal-use license unless a written agreement grants broader rights. Participant original journal content remains the participant’s content. ### 10. Prohibited copying, replication, and reverse engineering Except where a signed written agreement with My Life Spark P.C. expressly permits the activity, users may not copy, reproduce, republish, distribute, sell, sublicense, scrape, systematically extract, frame, mirror, white-label, or translate Vitanexia into a competing offering. Users may not use Vitanexia materials to build, train, validate, benchmark, market, or operate another product, service, curriculum, assessment, event system, Companion, platform, or substantially similar experience. Users may not reverse engineer, decompile, disassemble, decode, probe, map, reconstruct, discover source code or nonpublic logic, derive scoring rules or data structures, bypass access or usage controls, conduct automated extraction, remove ownership notices, impersonate an authorized partner, or assist another person with such activity. These restrictions apply to the fullest extent permitted by applicable law and preserve nonwaivable statutory rights and legally required exceptions. ### 11. Competitive and commercial use No public access, demonstration, professional attestation, event participation, download, or browser-local copy grants authority to commercially reproduce Vitanexia, offer a confusingly similar experience, create unauthorized adaptations, train a competing system on protected materials, or present Vitanexia content, structure, scoring, journeys, or visual identity as another party’s product. Co-branding, white-labeling, practice implementation, enterprise implementation, redistribution, adaptation, and commercial facilitation require a signed license from My Life Spark P.C. ### 12. Acceptable use Users agree to protect privacy, preserve participant agency, avoid coercion, maintain professional boundaries, use accurate claims, respect intellectual property, and avoid harmful, unlawful, deceptive, discriminatory, exploitative, or security-compromising conduct. ### 13. AI-supported content AI-supported prompts, summaries, suggestions, and personalization require human review. Outputs can contain errors, omissions, bias, or unsuitable language. Users remain responsible for interpretation, verification, and every consequential decision. ### 14. Availability and changes Features, schedules, content, facilitators, technology, pricing, and delivery methods can evolve. Material changes affecting active paid offerings will be communicated through reasonable channels. ### 15. Payments and refunds Offering-specific registration pages govern fees, payment timing, scholarships, cancellations, transfers, and refunds. Professional indemnification A professional using client-facing resources agrees, to the fullest extent permitted by law, to defend, indemnify, and hold harmless My Life Spark P.C. and its affiliates from claims, losses, liabilities, costs, and expenses arising from professional services, interpretation, facilitation, documentation, privacy, safety, scope, regulatory compliance, or representations made by that professional. ### 19. Governing law and dispute resolution Wyoming law governs these Terms, subject to legally required consumer-protection qualifications. Every dispute begins with good faith negotiation. An unresolved dispute proceeds to mediation. A matter remaining unresolved proceeds to binding arbitration. Court and jury proceedings are waived to the fullest extent permitted by law. Authorized administrators and service providers supporting hosting, security, storage, and operations may access audit records according to role and purpose. Audit payloads are designed to exclude the substance of journal entries, assessment answers, Daily Pulse text, passwords, and other free-form field contents. The site can link to third-party education providers, emergency resources, email clients, video platforms, event services, or future integrations.
